The three Frederick County deputies working an off-duty assignment at the Regal Cinemas the night a man with Down Syndrome died are now on administrative leave.
The incident happened on January 12th, when 26-year-old Robert Saylor refused to leave the theater or pay for another ticket after having already watched the movie. The deputies who were working security for Hill Management responded to the theater. They asked Saylor to leave and he refused so he was forcibly removed. Saylor struggled with deputies and was briefly handcuffed before having a medical emergency. He was then taken to the hospital where he was pronounced dead.
Cpl. Jennifer Bailey said Saylor's death has been ruled a homicide by the State Medical Examiner, who determined that he died from asphyxia. The deputies involved are Lt. Scott Jewell, Sgt. Rich Rochford and Deputy First Class James Harris.
"They have all been with us a fairly long time and at this point they have been placed on administrative leave pending the outcome of the investigation," Cpl. Bailey said.
Cpl. Bailey said there are two investigations going on right now.
"There is a criminal investigation. Basically, investigating the death of Mr. Saylor to determine what caused the death and also there is an internal affairs investigation that’s looking at the administrative side and whether or not the deputies acted appropriately," Cpl. Bailey said.
Since Saylor's death, the Sheriff's Office has received numerous calls and e-mails and may now set up a special call center to handle the high volume of questions coming into the agency.
