The Maryland Senate this week voted to eliminate jail time for anyone caught with small amounts of marijuana.
Frederick County States Attorney Charlie Smith is against this measure and said it will make it easier for drugs to be sold in the state.
"They (drug dealers) have runners, usually they use 13 or 14 year olds, because they know that very little happens to them. What they will do is have the kids run their 10-ounce bags, this is actually fairly good legislation for drug dealers."
Senators who voted in favor of this measure, say it will save the state money by not having those cases run through the criminal justice system.
Those against it worry it would encourage kids to smoke pot.
If the measure passes both houses, people caught with 10 grams or less of marijuana would face a $100 fine in civil court.
