Point Of Rocks Man Receive No Jail Time For Child Pornography Convictions

But he will be placed on specialized sex offender supervision.

 


Frederick, Md (KM). A 10-year suspended sentence with all but five days already served was handed down on Tuesday to a Point of Rocks man convicted of child pornography offenses. Abe Mallik, 56, was given five years of specialized sex offender supervision, and must register as a Tier One sex offender. That’s a requirement  Mallik must adhere to for 15 years.

“We’re happy to see him do some jail time. He didn’t get any additional jail time. But he is going to be on this specialize sex offender supervision. He’s going to be registered as a Tier 1 sex offender, and he is going to have 10 years hanging over his head if he screws up,” says State’s Attorney Charlie Smith.

Mallik was convicted on June 2nd of 11 counts of possession of child pornography.

In March, 2016, the Frederick County Sheriff’s Office received a tip from the National Center for Missing and Exploited Children about possible child pornography activities, according to a release from the State’s Attorney’s Office. Detectives  reviewed Google business records, and found communications with minor females and eight images  of confirmed child pornography being uploaded to an attachment using the defendant’s e-mail address.

A search warrant was served on Mallik’s home, where investigators found numerous digital devices. A forensic analysis was performed by the Department of Homeland Security where more than 200 images of child erotica were found on the defendant’s laptop. Three images were confirmed as child pornography, according to the State’s Attorrney’s Office.

At the time charges were filed against Mallik, he was working for the federal government.

During the trial, Smith says Assistant State’s Attorney Joyce King presented a convincing case before the jury. “He {Mallik} tried to say that it wasn’t him. That it was a work dispute. That’s somebody planted this against him,” Smith says. “Oftentimes these men who possess this child pornography by all appearances are law abiding citizens. So they’re very difficult. But she {King} put together a great case. The evidence was overwhelming. The jury rejected his whole defense. They convicted him.”

There are those who argue  that these types of offenders are only possessing child pornography, they’re not producing it.  However,  Smith says it has been manufactured. “But it creates an industry for the production of child pornography because a lot of these guys want new material. Of course, in order to get new material, you have to film it or photograph it, and it’s young kids being molested.”

In addition to the Sheriff’s Office and the Department of Homeland Security, the FDA’s Office of Criminal Investigations’ Internal Affairs Office, and the US Department of Health and Human Services, Office of the Inspector General, Office of Investigations, also helped in this investigation against Mallik.
