They were granted three weeks by a US District Court Judge.
Baltimore, Md (KM) A US District Court Judge on Friday denied federal prosecutors’ request for additional time to file a new indictment against the owner of the Machine Gun Nest in Frederick.
Robert Krop and Sheriff Chuck Jenkins were indicted last year for conspiracy and making false statements to illegally obtain machine guns. Krop was also charged with illegally possessing a machine that Jenkins allegedly helped him get. Both men have pleaded not guilty to the charges.
The Frederick News Post reports that on May 3rd, 2024. Judge Stephanie Gallagher ordered the indictment against Krop be dismissed without prejudice, agreeing with Krop’s attorney that the defendant’s rights to a speedy trial were denied. She gave prosecutors until May 24th to come up with a new indictment, or decide not to pursue the case.
The indictment against Sheriff Jenkins still remains. His trial date is scheduled for January 27th, 2025.
