FREDERICK, Md. (AP) – Three people who filed an appeal to the decision to remove the bust of Roger Brooke Taney outside Frederick City Hall have withdrawn their petition.
The Frederick News Post reports Charles Eyler filed a petition Tuesday asking to dismiss a petition for judicial review. He previously filed the petition with two other people against the Historic Preservation Commission’s approval that allowed Frederick to remove the bust.
Eyler, Theresa Mathias and John George wrote in a letter that they don’t think the community could find a solution to the issue that preserved the historical significance of the busts without conveying praise of them.
Taney, as the fifth chief justice of the United States, wrote the Dred Scott v. Stanford decision saying African-Americans couldn’t sue in federal court.
