Court Upholds 2nd-Degree Rape Conviction In Frederick County

Frederick, Md (KM) The 2nd-degree rape conviction of a man tried in Frederick County has been upheld by a state appellant court. The Maryland Court of Special Appeals has affirmed the conviction of Llosvani Galvez, 32, of Temple Hills. The opinion was filed on Thursday, May 23rd.

According to the State’s Attorney’s Office in a statement, the defendant’s lawyer argued that the trial court made a mistake in allowing the prosecution to introduce as evidence Galvez’s prior conviction in assaulting the victim, nothing that the two had resumed their relationship. But the appeals court judges agreed with the State that past crimes had a special relevance in this case, and the defense had argued at trial that rape allegation was not credible as the victim and Galvez had  made up. The State’s Attorney’s Office had argued during the trial that the cycle of domestic violence between Galvez and the victim helped explain how future reconciliation was not inconsistent with forcible rape, according to the statement.

Galvez was convicted of 2nd-degree rape on February 10th, 2017. He was sentenced on May 9th of that year to 20 years in prison with all but 12-years suspended. He must serve 50% of that sentence before he’s eligible for parole   Upon his release, Galvez will be placed on three-years supervised probation, and must register for life as a sex offender.
