Bill Requiring Planning Commission, Board Of Appeals Members To Be Impartial Passes Council

The measure was proposed by Councilman Tony Chmelik.

Frederick, Md (KM) Legislation to provide guidance to members of the Frederick County Planning Commission and the Board of Appeals regarding cases and issues being considered by their respective boards was adopted Tuesday by the County Council.

The measure, sponsored by Councilman Tony Chmelik, would require members to act with independence, integrity and impartiality, and not make a commitment, pledge or promise regarding cases or issues before their respective bodies. It would also require members not to make any statements which could compromise the fairness of deliberations or actions pending before the Planning Commission or Board of Appeals. They could not disclose any non-public information for purposes not related to their official duties.

The legislation passed by a unanimous vote.

Tuesday’s meeting was completed in less than five-minutes, and was the final one before the general election on November 6th. The Council will meet again on Tuesday, November 13th.
