Frederick, Md (KM) The Maryland Court of Special Appeals has upheld the conviction of a Frederick County man who assaulted a woman just over two years ago.
Attorneys for John Mullican IV raised several issues before the high court, all of which were turned down by the judges. The Court ruled the trial court did not abuse its discretion when it denied the appellant’s motion for a new trial, as well as the court’s ruling not to admit a defense photo. The judges also said that the trial court did not abuse its discretion in admitting 19 injury photographs into evidence.
Mullican was convicted on May 22nd, 2017 for 1st-degree assault and 2nd-degree assault. He was sentenced on November 7th to 25-years in prison with all but 20-years suspended. Mullican will have to serve 50% of that time in order to be eligible for parole because he was convicted of a crime of violence.
Mullican was arrested in October, 2017 following a domestic incident at a home on Houck Road in Union Bridge. The Sheriff’s Office says the victim was grabbed and slammed into items of furniture in her living room. She was taken to Frederick Memorial Hospital with lacerations and bruises to her head, face and arms. Authorities say the victim suffers from a fracture nose, injury to the right eye orbital, a laceration requiring staples to the back of her head, and a subarachnoid hemorrhage.
