Hagerstown Man Convicted By Frederick County Jury On Drug Charges

Sentencing is scheduled for April 10th, 2019.

 

Frederick, Md (KM) A Frederick County  Circuit Court   jury on Thursday handed down a guilty verdict to a Hagerstown man. Justin Mitchell, 35, was found guilty of possession with intent to distribute Alprazolam, possession of Alprazolam, possession with intent to distribute marijuana, possession of marijuana and possession of Metandienone.

“Unfortunately, they were unable to agree to a verdict on the charge of a firearm in conjunction with a drug trafficking crime,” says State’s Attorney Charlie Smith. “We really would have like to have that charge, but a mistrial was declared on that because the jury was hung.”

Sentencing is scheduled for April 10th, 2019.

According to the State’s Attorney’s Office, on June 20th, 2017, a landlord where Mitchell lived in Frederick County smelled a strong odor of marijuana coming from the defendant’s room. Upon entering, the room, the landlord found large bags  of marijuana and called 911.

Authorities say deputies responded and also smelled the odor of pot. A search and seizure warrant was obtained and it was served on the residence. The deputies found a total of 793.9 grams of marijuana, 990 bars of Xanax, a bag of anabolic steroids, a Mossburg shotgun, a Glock 19 handgun, a digital scale, baggies and a vacuum sealer.

Prosecutors say Mitchell was not home at the time of the operation. He was later arrested with $2,243.00 in cash on his person.
