The defendant was also granted bail.
Frederick, Md (KM) The trial of Ean Davis-Lattimore, 17, of Frederick has been postponed for a second time.
The defendant is charged as an adult with 2nd-degree murder, and two counts of 1st-degree assault. He was arrested last year for the shooting death of Genesis Marie McCarter-Berretto of Frederick. The shooting happened during after prom party in the 1800 block of Weybridge Road in Frederick early Sunday morning, May 13th, 2018.. David Lattimore denies he committed the shooting.
The postponement of Davis-Lattimore’s trial was granted by Circuit Court Judge Julie Stevenson Solt. State’s Attorney Charlie Smith says it gives his office more time to look over the evidence gathered by detectives and the defense.”It’s our obligation to insure that the case is fully presented to a jury, and that they have all the information they need to deliberate, including the forensics, including running down the defense alibi witness,” he says.
The case had been scheduled to go to trial in December, 2018, but that was also postponed to March, 2019.
In addition to granting the postponement, Judge Solt also granted a cash bond to the defendant totaling $100,000. If he’s able to post that amount, Smith says David-Lattirmore will be let out of jail, but he will be monitored by the Department of Parole and Probation. “If he posts the $100,000 cash bail, then he will be subject to pre-trial services and pre-trial supervision. There’s various measures that they take in order to insure somebody’s compliance with that bond as well as appearance at trial,” says Smith.
Davis-Lattimore has been incarcerated since he was arrested in May, 2018.
