Frederick County Grand Jury Indicts Nine People

One is charged in an offense which occurred seven years ago.

Frederick, Md (KM) Nine people were indicted Friday by the Frederick County Grand Jury, including a suspect in an incident from seven years ago. .

The panel charged Roberto Carlos Campos-Roque, 43, with 2nd-degree rape, 2nd-degree assault and kidnapping.

Frederick Police say during the early morning hours of March 24 and 25, 2018, Campos Roque, with assistance from another patron, allegedly dragged a woman who was intoxicated from the Cellar Door restaurant to his car.   He was seen dancing with that woman shortly before the business closed.

The victim was removed from the vehicle on Market Street several hours later with the assistance from some witnesses, The driver then drove off.   The two witnesses said the driver matched Campos-Roque’s description .

The victims  was taken to the hospital with injuries consistent with sexual assault.

Campos Roque was located in Baltimore in June, of this year where he was taken into custody on an unrelated charge   He was brought back to Frederick.

In addition to this case, the Grand Jury issued a superseding indictment against Deangelo McKinley Dubose, 18, of Washington DC, who is charged with 1st degree assault; 2nd-degree assault; unlawful taking of a motor vehicle; theft between $1500 and $25,000; conspiracy to commit theft between $1500 and $25,000; obstructing and hindering; malicious destruction of property valued at more than $1,000; driving without a license; two counts of fleeing and eluding;  and failure to remain at the scene for an offense which occurred on May 5th, 2025.

The other indictments include:

*Corey Antonio Green, 35, of Gwynn Oak, Md, who is charged with possession of a firearm with a felony conviction; illegal possession of a regulated firearm; having a loaded handgun on his person; having a handgun on his person; having a loaded handgun in a vehicle; having a handgun in a vehicle; and illegal possession of ammunition for an offense which occurred June 28th, 2025.

*Xerxus Rashad Belvin, 46, of Henderson, North Carolina, who is charged with possession of a large amount of cocaine; possession of a fentanyl; bringing  cocaine into the state; transporting fentanyl into the state; possession with intent to distribute cocaine; possession with intent to distribute fentanyl; driving with a suspended out-of-state license; exceeding the maximum speed for an offense which occurred on April 25th, 2025.

*Michael Andrew Smith, 46, of Baltimore, Md. who is charged with possession of cocaine with intent to distribute; driving under the influence; and refusal to take the alcohol and drug test for an offense which occurred on May 26th, 2025.

*Marlon Dwight Tyler, Jr., 41, of Adelphi, Md.,  who is charged with possession of a firearm with a prior conviction; having a loaded handgun in a vehicle, illegal possession of ammunition; reckless endangerment; possession of a synthetic cannabinoid; firearms access by minors; having a detachable magazine over ten rounds; driving under the influence of alcohol; driving without a license; failing to secure a child under the age of eight while being transported in a vehicle; driving under the influence of alcohol while transporting a minor; and driving while impaired while  transporting a minor for an offense which occurred on June 14th, 2025.

*Milton Leroy Powell III, 55, of Frederick, MD, who is charged with 1st-degree assault; 2nd-degree assault; theft between $100 to $1500; attempting to drive a vehicle on a highway without the required license or authorization; failure to immediately stop, return or remain a at the scene an accident involving bodily injury; failure of a  driver involved  an accident to render assistance to an injured person for an offense which occurred on April 19th, 2025.

*Walter Samuel Burke, Jr, 47, of Frederick Md. who is charged with 1st-degree assault; two counts of 2nd-degree assault; and reckless endangerment for an offense which occurred on June 21st, 2025.

*Esmeralda Shaina Pesquiera, 33, of Frederick Md. who is charged 2nd-degree child abuse by a custodian and 2nd-degree assault for an offense which occurred on June 2nd, 2025.

these indictments move these cases to the Circuit Court where trial dates will be scheduled.

The Frederick County State’s Attorney’s Office says indictments are charging documents alleging criminal conduct, and all defendants are innocent until proven guilty.
